The federal government is hesitant to hand up the power to local governments, who claim they have the constitutional right to oversee education up to grade 12. While schedule 9 puts education under the continuous control of the federal, provincial, and local governments, schedule 8 specifically grants local governments sovereignty over basic and secondary education.
The Constitution lists the authorities in general terms, while the Acts and regulations give them precise definitions. They are also a necessity for putting the constitution into effect. The administration has yet to register a bill to publish a federal education act, despite the fact that it has been almost seven years since the constitution was adopted and five years after the most recent legislative elections.
